PSARA Eligibility & Disqualification

Indian citizens and Indian-registered entities that meet Act and State Rules criteria may apply. Private Limited companies, LLPs, partnerships, and proprietorships appear across State practice; Pvt Ltd is often preferred for scale, investor comfort, and institutional tenders.

Persons convicted of certain company-related fraud offences, persons convicted of offences with imprisonment of not less than two years, persons linked to banned organisations posing threats to security/public order, and persons dismissed from government service for misconduct/moral turpitude face statutory bars. Companies/firms are ineligible if not registered in India or if controlled by non-citizens as majority owners/partners/directors under the Act's structure rules.

PSARA is sensitive to foreign control. Do not assume FDI-friendly structures used in other sectors automatically work for security agencies. Take counsel before onboarding foreign shareholders or nominee arrangements.

Beyond hard legal bars, Authorities assess practical fitness: clean police verification, coherent office presence, training arrangements, and in some States financial capacity proofs (ITR, bank statements). Suppressing pending cases is worse than disclosing and curing.

Some States expect skill certificates, prior PSA experience, or ex-servicemen/police background evidence for licensees or key managers. Build the team narrative into the dossier rather than inventing it after a query.
