Understanding PSARA License

The Private Security Agencies (Regulation) Act, 2005 — commonly referred to as PSARA — is the central legislation that governs the private security industry in India. Any individual, partnership, or company intending to deploy security guards for hire must obtain a valid PSARA License from the state's Controlling Authority before commencing operations.

Why PSARA License is Mandatory

Operating a private security agency without a valid PSARA License is a criminal offence under the Act. Penalties include fines up to ₹25,000 and imprisonment for up to three months. Beyond legal compliance, a PSARA License is a basic eligibility requirement for almost all institutional clients — factories, hospitals, malls, residential societies, and government facilities all insist on PSARA-compliant vendors.

Key Requirements Under PSARA

  • Entity Structure: The agency must be registered as a company, LLP, or partnership firm with main objects that expressly permit private security agency activity.
  • Registered Office: A verifiable commercial premises within the state of application with utility proof and inspection readiness.
  • Training Institute MOU: A memorandum of understanding with a State-recognised security training institute covering unarmed and armed guard curricula.
  • Police Verification: Character and antecedent verification of all proprietors, partners, or directors through the district police or Special Branch.
  • Affidavits and Forms: Non-conviction affidavits, uniform design approval, and such forms as prescribed by the state's Controlling Authority.

Who Needs PSARA License?

Any person or entity that provides security guards, supervisors, or related security personnel for hire must hold a PSARA License. This includes:

  • Private security agencies deploying guards at commercial, industrial, or residential sites
  • Manpower suppliers transitioning into security services
  • Facility management companies providing security as part of integrated services
  • Event security providers deploying temporary manpower

Validity and Renewal

PSARA licenses are typically valid for five years from the date of grant, though some states like Madhya Pradesh, Chhattisgarh, and Uttarakhand are widely noted for one-year validity regimes. Renewal must be applied for before expiry with updated documentation, proof of continued compliance, and payment of prescribed fees.
